1. Period of membership shall be 5/10/20 years starting from the date of receipt of membership certificate which be issued or after payment of the Membership fee by the member.
2. The applicant shall submit duly filled membership application from (“ Application “ along with the Admission fees (as mentioned in Annexure I ) . ( II ) If the Application is accepted by the Company . In case of rejection of the Application , the Company shall refund the membership fees by deducting Tax administration fee ( INR 5000 ) & others Misc. (III ) The decision of the management of the Company with respect to admission / rejection of the application as a member of the Company shall be Final .
3. The membership fees shall be paid as per the payment plan mentioned in Annexure I attached of the T & C.
4. Subject to no amount being outstanding from the Member to the Company ,the member will be entitled for 7 nights stays or each year commencing from such time properties are on board of the Company for usage by the members of the Company and receipt of complete Membership Fee , whichever is later ( “ Night Stay “ ) . Out of these 7 night stays the member can utilize maximum seven (7) nights in a year at any single property , the member can , after the Membership Usage Day ( as mentioned in Annexure I ) utilize complementary night stays as mentioned in the Annexure ( “ Complementary Nights “ ) at the renowned Company , resorts or hotels (“Reciprocal Places “) at such destination as may be offered by the Company from time to time . The Member can enjoy , in advance , maximum of fifty percent (50%) of his Night Stay succeeding Year in the present Year . Also the member can carry forward maximum fifty percent (50% ) of his unused Nights Stays of the present year in the succeeding year . Maximum Night Stays that can be utilized by the Member in year is twelve (12) , At the time of reservation .In case only one (1) Night Stays is booked by the Member , the Company will count the same as reservation of one (1) Night Stays and accordingly , the one (1) nights Stays will be debited from the total Night stays of the concerned Member in a year ,by the members only . The charges for food and beverages and other facilities shall be extra and not included in Night Stays / Complimentary Nights . “ Family Members “ shall mean and include spouse and two children below the age of 12 years of a Member .The Company may and or remove properties in the list of on Board Properties of the Company .
5. The Member while utilizing the Night Stays / Complimentary Nights shall comply with the rules , policies and conditions of the concerned of the Company , On Board Properties or Reciprocal Places.
6. (i) Booking shall be done as per the policy of the Company/On Board Properties/Reciprocal Places. (ii) Zero cancellation charges, however, on cancellation the number of Night Stays/Complimentary Nights canalled shall be debited from the total number of Night Stays/Complimentary Nights available to fine Member in that concerned year.
7. When the Member makes the full payment of the Membership Fees , the Company shall issue a Certificate of Membership (“COM”) to such Member.
8. The Member required to pay an annual maintenance fees (“ AMF”) to the Company which may be revised from time to time .
9. The Membership can be terminated if the Member(s) defaults in payment of Membership Fees /AMF/ Concerned taxes referred to Annexure I(b) breaches the terms of T&C, Policies of the Company / Reciprocal Places ; (C) guilty of misconduct ; or (d) any other action of the Member which the Company thinks is wrong/unlawful or (e) the Member is convicted in criminal matter . Travel Membership is non cancellable and non refundable .
10. Do note that during blackout period i.e. Diwali period and New Year season ( 24 Dec. to 5 Jan ), no bookings will be entertained . ( Except premium memberships).
11. To utilize your nights or Air Tickets its mandae to send a request between 45-65 days prior to the date of commencement ( Except premium membership ) . Rooms or tickets are subject to availability .
12. Reservation (“Reservation”) for Night Stays can be made at the time between the period starting from three (3) months till seven (7) days prior to the commencement of the actual period of utilization of the Night Stay and for complimentary Nights the reservation should be made one month prior to the actual utilization of the Complimentary Nights. The Reservation shall be done first-come-first serve basis subject to availability .
13. The Member can withdraw their membership with a free look period of 15 days from date of joining .
14. If for some reason, the Companies unable to provide accommodation after confirmation of Reservation to the Member, the Company shall provide alternate accommodation to the Member failing which , the Company shall only be liable to pay liquidated damages equivalent to 100% of the rent/tariff which is applicable on the rooms for which reservation was confirmed .
15. Notwithstanding anything mentioned herein above including Clause 15 above , the Company shall not incur any liability, in case Company is not in a position to fulfill its obligations due to the occurrence force majeure event .
16. The Member hereby covenants that to the maximum extent permitted by the Applicable Laws , the Company / Company shall not be liable for any direct, indirect, special, consequential or exemplary damages, including without limitation , damages for intangible losses , resulting from (a) any use or inability to use the Company facilities including , without limitation , disruption arising from any cause or (b) unauthorized access to or alternation of personal information or membership data of the Member . If in case , the Company is adjudged to be liable by a couft or other body or competent jurisdiction for the same , the Member , for any reason whatsoever , agrees and understands that he may not recover damages in excess of the amount of Membership Fees actually paid by him to the Member . The limitation of Contained in this paragraph are a material part of this T&C which provides Membership to the Member .
17. Member shall be liable to pay all taxes applicable taxes or imposed on the Membership Fees / AMF / Reservation ,from time to time.
18. The Member hereby acknowledge that on siging this T&C, the Member gives his consents to the Company to regularly reach out ot the member through Phone/mobile/SMS/social media etc. for new schemes and other value additions, even if the Member is in the TRAI regulated ONO The klember understands that he/she should register change of address/telephone numbers/email ID etc. If any. with the Company in order to keep the record of tha Company up a date. In case, the Member shifis out of India then he shall pay such amount as may be fixed by the Company, from time to ume. towards increased administrabve expenses. me Member hereby convenants that he shh not indulge in any illegal activity such ag Gambling, harassment. prostitution or any kind of illegal acovny urdar any law during his may in the Company/ReceiprocalPlaces.
19. The membership structure may contain various types of membership containing diPerent kind of rights for each type of rights for each type of membership. Any one type of membership may have privilege and special right and differential pricing over others. the member shit not raise any objecbon in this regard and has to accept the plicy and rules of the Company.
20. the Member understands that it is a vacation membership arrangement and availability of properties is subject to limitation. So if due to unavailability properties/rooms/accommodation on your required dates, you are unable to tuilise your stay entitlements then the Company shall not be liable for the same in any manner .
21. The Member is allowed to gift / sell / transfer his Night Stays or Air ticket subject to the policies of the Company and subject to no amounts being outstanding from the Member to the Company T&C apply .
22. T&C shall be governed by Indian laws and only the courts and tribunals of competent jurisdiction at Baroda shall have exclusive jurisdiction with respect to any proceeding relating T&C .
23. Anny dispute arising , between the Company and the concerned member shall be resolved by referring the matter to sole arbitrator appointed by the Company who shall decided the matter in accordance with the Arbitration & Conciliation Act 1996 . All Judiciary process will be subject to the Jurisdiction of Kolkata.
24. All benefits and facilities mentioned the forms or catalogue or any other document of the Company are Subject to change and Member shall not be entitled forany claims in respect of such changes.
25. Brochure is only for representative purpose . If cannot be held Accountable for any legal proceedings .
